Woman Charged Following Scuffle With Police Pleads Not Guilty

The Rochester woman charged after a scuffle with police pleaded not guilty on Tuesday.
Brenda Hardaway, 21, is charged with second degree assault, resisting arrest and unlawful possession of pepper spray.

Hardaway appeared in State Supreme Court to answer to a six-count indictment in connection with her arrest in Rochester in August. Two of the charges against Hardaway are felonies.

Police went to her family's home for the report of a fight. When officers attempted to arrest Hardaway's 16-year-old brother, a neighbor started recording the incident on camera.
Hardaway, who claims she is pregnant, was seen getting into a scuffle with police.
Police claim Hardaway pulled pepper spray on one of the officers.

"The video, when the two videos in this case are reviewed clearly and closely, the strength of the peoples' case becomes apparent when considered in light of the response of the police the day and the reason for their response and how events unfolded once police arrived on scene that day," said prosecutor Brian Green.

Hardaway had been free on bail, but the judge raised her bail to $25,000 cash or bond. The judge expressed concern that she could have future contact with law enforcement before her next court date Nov. 12.
