Marvin Sevilla-Rosales, 19, is charged with first degree rape, irst degree rape.
Rochester police said on July 5th around 7:30 p.m. he knocked on the victim's door. She answered and he forced his way into her apartment and raped her. Investigators say he bit the victim several times during the attack then stole some of her belongings.
Prosecutor Julie Hahn says the victim is working on her recovery.
"She's in the process of trying to move forward in her life and recover," said Hahn. "It's a very long process."
Hahn said Sevilla-Rosales is from Honduras and was granted political asylum in the U.S. She would not say why he was given that status.
Police say he is homeless and was living in the city's old subway bed. They are still investigating if Sevilla-Rosales is connected to other rapes in the area.
"The police are doing their job to see if in fact that's the case. As I said I can't really comment any further because it's a pending investigation. Right now we have him indicted on one incident that had occurred on July 5th," explained Hahn.
Sevilla-Rosales made a statement to police. Hahn would not comment on what was said.
The judge issued an order of protection for the victim. Sevilla-Rosales is being held on $75,000 cash bail. He's due back in court at the end of August.
Prosecutors and police are still asking anyone who might recognize him or know any other information to call police.
