1 of R. Kelly's defense attorneys says the prosecution will have to prove Kelly produced the videotape footage that's at the center of the singer's child pornography trial.
Ed Genson made the comment to one juror today during the jury-selection process.
He also says prosecutors must demonstrate that the female who appears in the videotape was underage.
A judge, prosecutors and defense attorneys are vetting potential jurors in a third day of jury selection.
They chose eight jurors earlier this week.
Seven people were dismissed after a round of questioning this morning in a process that will pick a total of 16 jurors, including four alternates. Three others were retained by the state but hadn't yet received the prosecution's approval.
Kelly is accused of videotaping himself having sex with a girl as young as 13. He's pleaded not guilty.
